1. Agreement

These Terms are a binding contract between you and KayKav Creative Studio LTD, a company incorporated in Nigeria ("Kaykav Academy", "we", "us"), governing your use of kaykav.academy and the learning platform at learn.kaykav.academy.

By creating an account or purchasing a course, you accept these Terms. If you don't agree, don't use the platform.

2. Eligibility

You must be 16 or older. If you're between 16 and the age of majority where you live, you confirm a parent or guardian consents to these Terms.

3. Your Account

• Provide accurate information
• Keep your password confidential
• One person per account. Accounts are personal and non-transferable
• Tell us immediately at support@kaykav.academy if your account is compromised
• You're responsible for everything that happens under your account

Account sharing is a material breach. If we detect credential sharing, we may suspend or terminate without refund.

You do not need to create an account before making a card payment. To use a course bought without an account, you must later create or sign in to an account whose email address has been verified and matches the email address Paystack confirmed for the payment.

4. Courses and Access

What you're buying: a personal, non-exclusive, non-transferable, revocable licence to access a specific course for your own learning. You are not buying the content itself.

• For a signed-in buyer, access begins once payment clears — automatically for card payment, or once we have verified your bank transfer (§5). For a card payment made without an account, paid access is held for the payment email until it is claimed as described in §5.2
• Access is per course and non-transferable. A signed-in purchase is added to that account. A purchase made without an account is bound to the email address Paystack confirms for the payment
• Access duration: LIFETIME. A course you have purchased stays in your library permanently. It does not expire, and there is no renewal to miss. Lifetime access is subject only to the revocation grounds stated in these Terms — refund (§6), chargeback (§7), and termination for breach (§13)
• We may add a subscription tier later; that will have its own terms, and it will not change the lifetime access you already hold
• We may update, revise, or retire course content. Substantial retirement of a course you purchased will be notified in advance

5. Payment

We offer two ways to pay, and they work differently. Which ones you see depends on your currency and region.

5.1 Bank transfer (manual verification)

• At checkout you give us your name, email address, and phone number, and we create an order
• We show you our bank account details and an exact amount to transfer. That amount is unique to your order — it is how we match your payment to you, so please transfer the exact amount shown
• The page shows a short countdown. It is a prompt, not a deadline. Your order stays open, and a transfer that arrives later still counts
• When you have sent the transfer, tap "I have made the transfer"
• A member of our team then verifies the payment against our bank records by hand. We aim to verify within 24 hours and email your access details to the address you gave
• Access is granted only when a person has confirmed the money arrived. If we cannot match a transfer, we will contact you rather than reject it silently

5.2 Card payment (Paystack)

• You may pay by card without creating an account first. We collect your email address at checkout and send it to Paystack with the payment amount, currency, reference, and course identifier needed to process and reconcile the payment
• Card payments are processed by Paystack Payments Limited, on Paystack's own hosted checkout page
• Your card details are entered on Paystack's page, not ours. We never see, handle, or store your card number, expiry date, or CVV
• For the payment and its confirmation we record your payment email, payment reference, amount, currency, status, and the last four digits and brand of the card. For a guest purchase, the address Paystack confirms for the successful payment is the payment email that controls who may claim it. The last four digits and card brand come to us from Paystack for support and fraud-handling purposes; they cannot be used to make a payment
• Paystack's own terms and privacy policy apply to the payment itself
• If you are signed in when you buy, access is granted automatically to that account once Paystack confirms the payment to us
• If you buy without an account, we email the payment address a receipt and a claim link. Your paid access remains pending and bound to that address until a matching, verified account claims it; it does not expire after 30 days
• A social sign-in may claim only when its provider has verified the matching email address. A password account may claim only after you complete email verification. An unverified or different email address cannot claim or transfer the purchase; sign in with the payment email address instead

5.3 Pricing

• Prices are shown and charged in the currency displayed at checkout
• The displayed price is the price you pay — we set regional prices deliberately; they are not live currency conversions
• You are responsible for any taxes, bank fees, or currency-conversion charges your bank or card issuer applies
• Prices may change; changes never affect courses you've already bought

6. Refunds

We want you to be able to buy with confidence. Our refund policy depends on where you live, because consumer law does.

6.1 If you are in the EU or EEA — 14-day right of withdrawal

You have 14 days from the date of purchase to cancel and receive a full refund, for any reason or none. You do not need to justify the request, and it does not matter how much of the course you have watched.

This is your statutory right under EU consumer law, and we do not ask you to give it up. We do not operate a waiver of the withdrawal right. Some platforms ask you to tick a box surrendering this right in exchange for immediate access; we do not. You get immediate access and the full 14 days.

To cancel, email support@kaykav.academy within 14 days of purchase. We will refund the full amount to the original payment method within 14 days of receiving your request.

6.2 If you are in the United States

The 7-day / 20% policy in §6.3 applies to you.

Your rights under your state's consumer protection law are unaffected by these Terms. Consumer protection rules vary by state, and where your state grants you a right we have not offered here, that right still stands.

6.3 If you are in Nigeria or anywhere else

You may request a full refund within 7 days of purchase, provided you have watched less than 20% of the course.

• "Less than 20% of the course" is measured against your recorded progress through the course's lessons
• Requests go to support@kaykav.academy, within 7 days of the date of purchase
• Beyond 7 days, or beyond 20% watched, we do not offer refunds — though if something has genuinely gone wrong, write to us anyway and we will look at it

6.4 How refunds are paid, and what happens to your access

• Card payments are refunded to the card used, through Paystack
• Bank transfers are refunded by bank transfer to the account the payment came from
• A refund ends your access to that course. Your enrolment is revoked, and any certificate you were issued for that course is voided. This is automatic for card refunds and is applied by us for bank transfers

7. Chargebacks

Contact us before disputing a charge. Most issues resolve in a day.

If you initiate a chargeback, your account access is revoked immediately and any certificate issued is void. This applies regardless of the dispute's outcome. Reinstatement requires the dispute being withdrawn and settlement of any resulting fees.

Fraudulent chargebacks may be reported and pursued.

8. Intellectual Property

All course content — videos, text, images, PDFs, downloadable files, exercises, the platform itself — is owned by Kaykav Academy or its licensors and protected by copyright.

You may:

• Watch, read, and study the content for personal learning
• Download provided PDFs and files for your own personal use
• Apply what you learn in your own professional work

You may not:

• Download, record, screen-capture, rip, or copy the video content by any means
• Share your login credentials
• Redistribute, resell, sublicense, upload, or publish any course material
• Use the content to build a competing course or training programme
• Circumvent any access control, DRM, or technical protection measure
• Scrape the platform or use automated access tools
• Remove copyright notices or watermarks

Circumventing our video protections is a material breach and a violation of copyright law. We terminate without refund and pursue infringement.

9. Completion and Certificates

Certificates are issued on full course completion — every lesson in the course, including any required assessments.

• Free navigation is allowed, but partial completion earns no certificate
• Certificates confirm completion of our course. They are not an accredited academic or professional qualification, and we make no claim that they are. They confer no academic credit and no professional licence
• Each certificate carries a serial number and can be checked by anyone holding it at learn.kaykav.academy/verify/[serial]. That page shows the holder's name, the course, the issue date, and whether the certificate is still valid
• We may revoke a certificate obtained through account sharing or fraud, and a certificate is voided by a refund (§6.4) or chargeback (§7)

10. Invited Accounts

We may invite students by email — for example, learners migrating from another platform, or buyers whose bank transfer we have verified by hand. Invites are tied to the invited email address, are non-transferable, and expire after 30 days. Access granted by invitation is subject to these Terms in full.

A claim link for a completed guest card purchase is different from an administrative invite: the paid access is bound to the payment email under §5.2 and does not expire after 30 days.

11. Acceptable Use

Don't: harass others, upload malware, probe or attack our systems, impersonate anyone, or use the platform unlawfully.

12. Availability

We aim for high availability but do not guarantee uninterrupted service. Maintenance, third-party outages, and force majeure happen. We will give notice of planned downtime where practical. Downtime is not grounds for a refund unless it's prolonged and material.

13. Termination

You may delete your account anytime by writing to support@kaykav.academy. Deletion forfeits course access and is not a refund.

We may suspend or terminate for breach — account sharing, piracy, chargebacks, abuse — without refund. Where the breach is minor and fixable, we'll usually warn first.

14. Disclaimers

Courses are provided "as is" for educational purposes. We do not warrant that they will produce any particular career, income, or professional outcome. To the extent permitted by law, we disclaim implied warranties.

Nothing here limits rights you have under mandatory consumer protection law in your country.

15. Liability

To the maximum extent permitted by law, our total liability for any claim is capped at the amount you paid for the course in question in the 12 months preceding the claim.

We are not liable for indirect, incidental, or consequential losses, or lost profits.

We do not exclude liability for death, personal injury caused by negligence, fraud, or anything else that cannot lawfully be excluded.

16. Governing Law and Disputes

These Terms are governed by the laws of the Federal Republic of Nigeria. Disputes arising out of or in connection with them are to be resolved in the courts of Nigeria.

This does not take away the consumer rights you have at home. If you are a consumer resident outside Nigeria, nothing in these Terms deprives you of the protection of any mandatory consumer-protection law of your country of residence, or of the right to bring proceedings in the courts of your country of residence where the law of that country gives you that right. Where a mandatory rule of your local consumer law conflicts with these Terms, that rule prevails over these Terms to the extent of the conflict.

17. Changes

We may update these Terms. Material changes will be emailed and posted 14 days before taking effect. Continued use after that means acceptance. Terms applying to a course you already bought will not change to your disadvantage.

18. General

• Severability: if a clause is unenforceable, the rest survives
• No waiver: not enforcing a right doesn't waive it
• Entire agreement: these Terms plus the Privacy Policy are the whole deal
• Assignment: you can't assign these Terms; we may, on notice, in a merger or acquisition
